This is the English translation of the Terms of Use of Nebul Player. The Portuguese version, available at nebulplayer.com/terms.html, is the governing version in case of any discrepancy.

These Terms of Use govern the access to, installation and use of the Nebul Player application on compatible devices. By downloading, installing or using the application, you expressly agree to these conditions. If you do not agree, simply do not use the application.

1. What Nebul Player is (and what it is not)

Nebul Player is exclusively a media player software application. The application is a neutral technology tool, comparable to an internet browser (web browser) or to traditional multimedia players.

The application arrives empty: Nebul Player does NOT contain, does not load and does not come with any playlist, channel, film, series or pre-installed content.

Absence of supply, curation or own library: Nebul does not provide, does not sell, does not resell, does not license, does not host and does not store an audiovisual library of any kind. We do not maintain a catalogue or a channel line-up of our own. Visual features of the application (such as grouping of categories, title search, display of "recently added" or enrichment of posters through public databases such as TMDb) constitute solely navigation and organisation tools of the graphical interface applied over the technical responses received from the connected server, without curation or editorial control by Nebul.

How the stream travels (Routing and Transient Cache): at the request of the user's device, Nebul's infrastructure may act as a technical intermediary (proxy) in order to enable the communication and the forwarding of the stream between your provider's origin server and your device. The stream only passes through in real time, without the content being recorded or distributed by us. In order to ensure stability and avoid redundant requests, the system may keep solely a volatile technical cache in temporary memory (of very short duration) for the catalogue responses requested, without persistent retention of any library. Depending on the stream (as in direct login or in HLS manifests with absolute addresses), the URL of the origin server may be known or accessed directly by the device.

How it works: the user or their operator enters the settings or credentials supplied by an independent service. Nebul Player merely decodes and plays that connection on your device.

2. Access, operation and playback quality

In order to use the playback features, you need to connect the application to a compatible server or service through an activation code or valid credentials.

Responsibility for the transmission: the availability of the channels, the stability of the video stream, the buffering, the picture quality (HD/4K) and the catalogue of titles depend exclusively on the access provider configured by you, on the speed of your internet connection and on the hardware of your device.

Formats and codecs: compatibility with certain audio and video formats may vary according to the technical specifications of your device and operating system.

Application features: tools such as favourites, search, history, parental control by PIN and the "Continue watching" function are utilities of the application's interface.

3. Rights over the content played

You declare and warrant that you will use Nebul Player solely to play media, transmissions and content over which you hold legal authorisation, a right of access, or which are in the public domain.

Respect for copyright: it is expressly prohibited to use the application to reproduce or distribute material in violation of the Brazilian Copyright Act (Law No. 9,610/1998) or of any applicable laws.

Absence of licences over works: the installation or any purchase of a licence for the Nebul Player application does not grant any right or licence over third-party works, television channels or protected content.

4. Software licence

We grant you a personal, revocable, limited, non-exclusive and non-transferable licence to use the Nebul Player application on your compatible devices, for strictly personal and non-commercial purposes.

It is strictly prohibited to:

5. Acceptable use rules

By using Nebul Player, you agree to:

6. Price, third-party services and division of support

Software vs. Content Provider: any amount charged by Nebul refers solely to the technology licence to use the application. Nebul does not charge for channels, streaming packages or live transmissions.

Relationship with third parties: any payments or subscriptions contracted with external playlist providers or streaming services constitute an autonomous legal relationship between you and the respective provider.

Division of Support:

7. Privacy and security of your data

The processing of data related to Nebul Player is described in the Privacy Policy, which sets out the rights provided for in the Brazilian General Data Protection Law (LGPD — Law No. 13,709/2018):

Playback credentials: the provider's server, username and password may be entered directly by you on the device or registered by your operator in the technical management Console. In both cases, the credentials remain encrypted in our infrastructure in order to enable authentication, activation and support for the operation of the application. The termination or expiry of a token technically invalidates access on the device, but does not automatically delete the encrypted record from the database. The data subject may send a deletion request to contato@nebulplayer.com, subject to the legal grounds for retention described in the Privacy Policy.

Local preferences: favourites lists and viewing preferences are saved solely in the memory of your device.

For full details on how we protect your data and your rights, please consult our Privacy Policy.

8. Parental control and age rating

Parental PIN: the application provides a Parental Control tool with PIN locking, allowing parents and guardians to block categories and content that are unsuitable for minors.

Age rating: the age ratings assigned to the application by the application stores indicate solely the age range recommended for the software in that storefront, and do not constitute a content licence nor any state authorisation for the supply of channels.

9. Availability and disclaimer of warranties

The application is provided "as is" and "as available". We work continuously to offer the best stability and performance, but Nebul does not warrant that the software will be 100% uninterrupted or free from failures arising from incompatibilities with external providers, instabilities in your internet connection or updates to third-party operating systems.

10. Notices for rights holders (Notice and Takedown)

Nebul has no editorial control, does not host and does not select the library of third-party servers, and does not maintain an editorial index of its own over that library. It cannot remove, edit or censor items within the catalogue of an independent provider.

What we can do, and do upon a substantiated notice: investigate the complaint, require clarification from the responsible operator, and suspend or terminate the activation, the account or the access involved, under these Terms and the Brand and Promotion Policy.

Copyright holders may notify the compliance channel at contato@nebulplayer.com, indicating the work, the ownership and the elements that make it possible to identify the access involved. We will reply informing the measures adopted.

11. Changes to these Terms

Nebul may update these Terms from time to time to reflect improvements in the application or changes in legislation. The most recent version and the date on which it takes effect will always be available on our official website (nebulplayer.com/terms.html).

These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Brazilian Internet Civil Rights Framework (Marco Civil da Internet — Law No. 12,965/2014) and the Consumer Protection Code (Law No. 8,078/1990).
